Letter to Chairperson of B.H.R.C on custodial death of Munna Singh.

Subject: - A request to make an enquiry in the case of custodial death of Munna singh.

Most Respected Sir,


With sincere regards I would like to draw your attention to the recent incident of custodial death of Munna singh which has shook the entire state of Bihar. Prima faciely, this case brings before us the most cruel, atrocious and inhumane face of Police department of Bihar.
The facts gathered on the basis of media reports telecasted and published in  Bihar are as follows :-

·        That, the police of Jamui Police Station (Bihar) lodged an FIR on 5th of May 2013  against the unknown offenders for abducting BankunthVarnvala, a cloth merchant and resident of Navinagar.

·        That, the Police in course of investigation have arrested Dablu Mishra of Navinagar who is a merchant and deals in Cement.

·         That, the police on the basis of the statement given by Dablu Mishra, made Munna singh (30yrs.)  of Lakhhapur village  as an accused in the case of abduction.(Not Primary)

·        That,  Munna Sigh after knowing the fact that he has been made an accused in the said case, surrendered himself before the district session court on 13th of june 2013.

·         That, on 20th/June/2013 as requested by the police the court for the purpose of making an inquiry about the said abduction allowed for 2days police remand.

·        That , during the remand period Police crossed all the limits by grossly violating the human rights of the accused by putting petrol, chilly powder, and police Stick ( Lathi ) in his anal.

·        That, on 22nd of june 2013 he was admitted in Sadar Hospital, Jamui in an extreme critical condition, where after first aid, the doctors referred him to P.M.C.H Patna.

·        That, after being referred to P.M.C.H  Patna his treatment was being done under the Police inspection secretly and his family members were not informed about the whole scenario.

·        That, from 28-29 may onwards his condition became too critical and he started vomiting the blood, seeing which Police informed his family members.

·        That, after tolerating unbearable pains given by the Police officials during remand period and because of being subjected to the highest form of inhumane treatment, he was declared dead by the doctors on 1stof july 2013(Monday).


(B.) WHY SHOULD BHRC INTERVENE AND ENQUIRE INTO THE MATTER:-


1.      Because, this is not the first incident where the state police has grossly violated the human rights of the accused but within a weak two incidents had took place where in one incident six people of Bihar had lost their life in police firing and the other resulted in custodial death. If these kinds of extra judicial killings are not stopped through the intervention of Human rights commission then the people of this country would lose confidence on the system and the enforcement of UDHR to which India is a signatory will remain like a document of no use. 

2.      Because, these incidents have produced a frightening image of the Police in the mind of the common People and state police will behave like an untamed hoarse.

3.      Because , the case of custodial death of Munna Singh is not only the case of gross violation of human rights but is also the case of violation of fundamental rights by the State (Right to life - Article 21 of the constitution of India)

4.      That, the ignorance of this issue by the commission will lead to the encouragement of the Police department in repeating the same kind of treatment with the accused in the future and the loss of the trust of the common people towards the commission and its judicial system.


Since the human rights commission is considered as the custodian of Human rights In India and who is aware of the police atrocities prevailed in state of Bihar and the unfair way of conducting investigation by the police where the accused are within the police department therefore I Rohit Kumar, a student of B.A.LL.B (2nd year) in KIIT School of Law, KIIT University, Bhubaneswar and a permanent resident of Village - Nagar Bihta, P.O.- Lai , P.S.- Bihta, Distt. - Patna (Bihar) - 801112, on the behalf of the aggrieved Party requests you to appoint a committee to enquire into the matter.
